Notice of application to the Commission for Regulation of Utilities (CRU) in respect of an application for consent under Section 39A of the Gas Act 1976 as amended and Invitation for Public Submissions or Observations for the Purposes of Conducting Stage 2 Appropriate Assessment.

The Commission for Regulation of Utilities (CRU) hereby gives notice of its receipt of an application for consent under Section 39A(1) of the Gas Act, 1976 as amended, from Gas Networks Ireland (GNI) in relation to the construction of an underground distribution gas pipeline at the customer’s (Tanola Ltd.) premises, Dundalk Business Park, Dundalk, Co. Louth.

It is proposed to construct a new 250m length of pipeline connecting two new industrial buildings (Block A and Block C) at the Customer’s Facility to the existing distribution network and associated tie in with the gas network. The entire pipeline route is located within the existing road network at Dundalk Business Park, Marshes Upper.

The CRU has determined, in accordance with Regulation 42(6) of the European Communities (Birds and Natural Habitats) Regulations 2011, as amended, that an Appropriate Assessment is required in respect of the proposed plan or project.

The CRU will make a determination as to whether or not the proposed plan or project would adversely affect the integrity of a European site in accordance with Regulation 42(11) of the European Communities (Birds and Natural Habitats) Regulations 2011 as amended and, in doing so, shall have regard to the matters in Regulation 42(12).

In this regard, in accordance with Regulation 42(13), any person may make a submission or observation to the CRU concerning the proposed project during the period of consultation detailed below. The CRU shall have regard to any submissions or observations received during this time.

The CRU is inviting responses from stakeholders which should be submitted via the consultation platform by the close of business on 10 July 2026.

  • a copy of the application for 39A Consent,
  • a copy of the Natura Impact Statement,
  • any other information available to the CRU for the purpose of the application,
  • any significant further information (if any) received by the CRU.
