Newtown Pipeline Section 39A Consent Application and associated EIA Report

Notice of application to the Commission for Regulation of Utilities (CRU) in respect of a proposed development subject to assessment under the Environmental Impact Assessment Directive 2011/92/EU as amended by 2014/52/EU.

The CRU has received an application for consent under Section 39A(1) of the Gas Act, 1976 as amended from Gas Networks Ireland (GNI). The application relates to the construction of an underground transmission gas pipeline in the townland of Kilshane, Dublin 11.

The overall development comprises:

i. The installation of a 0.715km long underground transmission gas pipeline along Bay Lane and Kilshane Road (this is the subject of the Section 39A application);

ii. An Above Ground Extension to existing Kilshane Block Valve Station; and

iii. A new Above Ground Installation (AGI), at the related permitted gas-fired power station

The proposed: (ii) Above Ground Extension to the existing Kilshane Block Valve Station; and (iii) new AGI are assessed in the EIAR submitted with this application for consent but are the subject of separate applications for planning permission. The area within the proposed development boundary extends to is c. 3.14H.

This proposed development, including its construction and operation, is subject to assessment under the Environmental Impact Assessment (EIA) Directive 2011/92/EU as amended by 2014/52/EU and an EIA Report (EIAR) has been submitted to the CRU with its consent application and can be found in the Materials section of this page.

In accordance with S.I. No. 174/2021, the CRU makes any EIAR received in relation to a Section 39A application available to the public for a consultation period of at least 30 days.

The CRU shall determine whether or not the proposed development would be likely to have significant effects on the environment and may decide to grant consent to GNI under section 39A(1), subject to whatever (if any) environmental conditions it considers necessary to avoid, prevent or reduce, or offset significant adverse effects (if any) on the environment, or refuse to grant consent under section 39A(1).

The CRU is inviting responses from stakeholder which should be submitted via the consultation platform by the close of business on 21 January 2026.
